3. Project Scope & Change Orders
Any work requested outside of the original agreed-upon scope must be approved through a written change order. Additional work may:
- Increase project cost
- Extend timelines
- Require additional materials or labor
No additional work will be performed without proper authorization.
4. Scheduling & Project Timelines
Project timelines are estimates only and are not guaranteed. Construction schedules may be affected by:
- Weather conditions
- Material availability and supply chain delays
- Labor availability
- Site conditions or unforeseen structural issues
- Permit approvals and inspections
R & D Construction is not liable for delays caused by factors outside of our control.
5. Permits & Inspections
When required, permits and inspections may be necessary for certain projects. Unless otherwise specified:
- Responsibility for permitting will be outlined in your project agreement
- Delays related to inspections or permit approvals are outside of our control
6. Client Responsibilities
Clients are responsible for:
- Providing accurate project information
- Ensuring access to the property during scheduled work times
- Securing pets and personal belongings
- Obtaining HOA approvals (if applicable)
- Making timely payments as outlined in agreements
Failure to meet these responsibilities may result in project delays or additional costs.
7. Payment Terms
Payment terms will be clearly outlined in your project agreement or invoice.
General terms may include:
- Deposits required prior to project start
- Progress payments for larger projects
- Final payment due upon project completion
Late or missed payments may result in:
- Work stoppage
- Additional fees
- Legal action if necessary
8. Materials & Product Variations
Due to natural variations and manufacturing differences:
- Colors, textures, and finishes may vary slightly from samples
- Material availability may require substitutions of equal or greater quality
We will communicate any significant changes prior to installation whenever possible.
9. Workmanship & Warranty
R & D Construction stands behind the quality of our work.
- Workmanship warranties (if applicable) will be outlined in your project agreement
- Manufacturer warranties apply to materials and products used
This warranty does not cover:
- Normal wear and tear
- Damage caused by misuse, neglect, or external factors
- Work altered or repaired by others after completion
10. Limitation of Liability
To the fullest extent permitted by law, R & D Construction shall not be liable for:
- Indirect, incidental, or consequential damages
- Delays caused by circumstances beyond our control
- Pre-existing conditions not visible or disclosed prior to work
Our liability is limited to the value of the contracted services provided.
11. Safety & Job Site Conditions
Construction sites can be hazardous. By engaging our services:
- Clients agree to keep unauthorized individuals away from active work areas
- R & D Construction is not responsible for injuries resulting from unsafe site access by others
12. Communication Consent
By contacting R & D Construction, you consent to receive communications via:
- Phone calls
- Text messages
These communications may relate to:
- Project updates
- Estimates and scheduling
- Service follow-ups
You may opt out at any time by contacting us directly.
13. Cancellations
Project cancellations must be submitted in writing. Depending on the project stage, cancellation may result in:
- Loss of deposit
- Charges for completed work or materials already purchased
14. Intellectual Property
